Federal Judge Mandates Freedom of Abrego Garcia from ICE Detention
A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement is without lawful basis.
"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her ruling.
The situation stems from a mistaken removal to El Salvador in March, which US authorities later admitted was an mistake. Following his return to the United States to face alien smuggling charges, he was held in immigration custody.
In her order, the judge pointed out that the authorities lacks a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."

The court proceedings center on disputed claims. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically denies this claim.
He has also entered a not guilty plea to the smuggling charges, which are part of a ongoing trial in Tennessee.
